This Privacy Policy discloses the privacy practices of Loba Wellness Inc. (“Loba”, “we” or “us”), and explains how we collect, use and disclose your personal and private information while you used our website www.shoploba.com (the “Website”) and our Loba mobile app (the “App”) and any of (collectively referred to as the “Services”). This Privacy Policy also covers how personal information that we receive or collect about you is treated. The term “you” or “User” refers to you, a consumer of the Services.

This Privacy Policy is designed to be read in connection with our Terms of Use, which is available at www.shoploba.com/policies/terms-of-service. By accessing or using our Services, you agree to be bound by both our Terms of Use, as well as this Privacy Policy. In the Privacy Policy, we go into full detail about our privacy practices and how we collect information, including your rights as a User. Unless otherwise defined in this Privacy Policy, all capitalized defined terms have the meanings ascribed to them in the Terms of Use.

Collecting Information

Our Services will only collect personal information about you that you knowingly and willingly provide to us, for example, during onboarding when creating a User Account, or when you make a purchase through our Services (“Personal Information”).

When you complete the account creation and onboarding process we may collect information such as your name and email address, as well as certain non-identifying information, like information related to pills or supplements you are taking, your own personal preferences and when you want to be reminded to take your pills.

We may automatically collect certain information pertaining to your computer or mobile device (“Device Information”) when you use Service, such as the operating system, the browser type, the address of a referring site and your activity with Loba. This information is not treated as Personal Information unless we combine it with or link it to any of the personally identifiable information mentioned above.

Device Information

  • Examples of information collected: version of device, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the app.
  • Purpose of collection: to load the website and app accurately for you, and to perform analytics on site and app usage to optimize our products and service.
  • Source of collection: Collected automatically when you access our app using cookies, log files, web beacons, tags, or pixels.
  • Disclosure for a business purpose: to help us understand how our customers use our website and app. 

Account Information

  • Examples of information collected: name, email, use of Loba, personal preferences, pronouns, age
  • Purpose of collection: to provide products or services to you, refer to you in the correct way, and present relevant information of interest to you.
  • Source of collection: collected from you.
  • Disclosure for a business purpose: to understand our customers and improve the delivery of our products and services.

Order Information

  • Examples of information collected: name, billing address, shipping address, payment information (including credit card numbers, email address, and phone number.
  • Purpose of collection: to provide products or services to you to fulfill our contract, to process your payment information, arrange for shipping, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
  • Source of collection: collected from you.
  • Disclosure for a business purpose: shared with our processor Shopify and shipping partners.

Customer Support Information

  • Examples of information collected:name, billing address, shipping address, email address, and phone number.

How We Use Information

We will primarily use your Personal Information specifically for the Services offered to you. We will also use certain forms of Personal Information to enhance the operation of our Services, improve our internal marketing and promotional efforts, statistically analyse Service use, improve our product and service offerings, and customize our Service’s content, layout, and features. We may use Personal Information to deliver information to you and to contact you regarding administrative notices. Finally, we may use your Personal Information to resolve disputes, troubleshoot problems and enforce our agreements with you, including our Terms of Use, and this Privacy Policy.

We do not sell any identifying Personal Information to third-parties.

We or any third-party advertising partners (as they may become applicable from time to time), may collect, certain Aggregate Information, including but not limited to the version of your device, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the App or Website.

We use Aggregate Information to analyse how our Users access and use our Services, and we use this information to enhance the performance of our Services and provide a more streamlined and enjoyable User experience. We may, for example, use your IP address to diagnose problems with our servers or software.

 

Cookies

Cookies are small pieces of data stored in text files that are saved on your computer or devices when websites are loaded in a browser. They are widely used to remember you and your preferences, either for a single visit (through a temporary “session cookie”) or for multiple repeat visits (using a “persistent cookie”).

Any use of cookies – or of other tracking tools – by the Services or by the owners of third-party services used by the Website or App is expressly for the purpose of better providing you with the Services, in addition to any other purposes described in this Privacy Policy or any other policy we may publish on our Services from time to time.

Security

Security of your User Information is of the utmost importance, so when you submit sensitive information through the Website, your information is protected both online and offline. Wherever we collect sensitive Personal Information, that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a “lock” icon in the address bar and looking for “https” at the beginning of the URL address of the webpage.

While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to Personal Data. The servers in which we store personally identifiable information are kept in a secure environment. This is all done to prevent any loss, misuse, unauthorized access, disclosure or modification of the user’s personal information under our control.

Data Retention

We will not retain Personal Information longer than is necessary to fulfil the purposes for which it was collected in the first place, or as required by applicable laws or regulations. For example, any Personal Information collected for purposes related to the performance of a contract between the Loba and the User, such as making a purchase from our Services, shall be retained until such contract has been fully performed.

We may be allowed to retain Personal Information for a longer period whenever the User has given consent to such processing, as long as such consent is not withdrawn. Furthermore, there may be circumstances in which we may be obliged to retain Personal Information for a longer period whenever required to do so for the performance of a legal obligation or upon order of an authority.

Once the retention period expires, Personal Information shall be deleted. Therefore, your right to access, right to erasure, right to rectification and the right to data portability cannot be enforced after expiration of the retention period and we no longer possess such data.

 

Disclosure of Information

We may not use or disclose your Personal Information except under the following circumstances:

  • as necessary to provide Services you have accessed, ordered or requested;
  • in other ways described in this Privacy Policy or to which you have otherwise consented;
  • in the aggregate with other information in such a way so that your identity cannot reasonably be determined;
  • as required by law, or in response to a subpoena or search warrant;
  • to outside auditors who have agreed to keep the information confidential;
  • as necessary to enforce the Terms of Use or any other policies or regulations related to our Services; or
  • as necessary to maintain, safeguard and preserve all the rights and property of Loba.

 

Behavioural Advertising

We may use your User Data to provide you with targeted advertisements or marketing communications we believe may be of interest to you. For example:

We maintain and reserve the right to contact you if needed for non-marketing purposes, such as bug alerts, security breaches, account issues, and/or changes in our products and services.

All Users have the option to discontinue receiving any emails or newsletter communications we may send to you from time to time. You may unsubscribe or opt-out of any such communications by following the instructions on the communication or by contacting us directly.

 

Links to Other Websites

Our Services may provide links to other websites that are controlled by third parties. We are not responsible for any of the content, user terms, or privacy policies for websites that we do not own or control. You are strongly advised to read the terms and policies of all websites you visit or mobile apps you use.

 

Minors

Loba is not intended for individuals under the age of 18.

We adhere to the Children’s Online Privacy Protection Act (COPPA) and will not knowingly collect Personal Information from any child under the age of 13. We ask that minors (under the age of 18) not use the Website or Services. If a child under the age of 13 has provided us with Personal Information, a parent or guardian of that child may contact us and request that such information be deleted from our records and termination of the corresponding account.

 

Non-Canadian Users

If you are not a resident of Canada, certain laws or regulations in your home jurisdiction may afford you certain rights with respect to your User Data. Please contact us if you have questions, concerns or requests related to non-Canadian laws or regulations, such as a request under the California Civil Code, California Business and Professions Code or the European Union General Data Protection Regulation.

Notwithstanding the foregoing, you acknowledge that Loba is a Canadian company and presently, this Privacy Policy, our Terms of Use, and our Services in general are intended for Canadian Users and governed by the laws of the Province of British Columbia, Canada. While we make best efforts to comply with various international regulations and legislation applicable to all of our Users around the world, you acknowledge and agree that the Services are targeted to a Canadian userbase, and non-Canadian Users use our Services at their own risk.

We reserve the right to make changes to this Privacy Policy at any given time. If you want to make sure that you are up to date with the latest changes, we advise you to frequently visit this page. We reserve the right to change or modify any of the terms and conditions contained in this Privacy Policy, at any time and in our sole discretion. We may inform you of any material changes via email or other notification or message (such as push notifications or in-app notices). Your continued use of the Services following any such notice will constitute your acceptance of such changes or modifications.
